Dear Secretary Keleher:

I am writing in response to the Puerto Rico Department of Education’s (PRDE’s) application to the U.S. Department of Education (Department) on June 18, 2018, to enter into a local flexibility demonstration agreement under section 1501 of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the Every Student Succeeds Act (ESSA). Specifically, PRDE applied to consolidate eligible Federal funds with State and local funds to create a single school funding system based on weighted per-pupil allocations for students from low-income families, Spanish learners, and otherwise disadvantaged students.

I have determined that the application meets the requirements under section 1501 of ESEA, as amended by ESSA. For this reason, I am approving PRDE’s application to implement the student-centered funding system described in its application, consistent with the requirements in the ESEA and the terms of the local flexibility demonstration agreement enclosed with this letter. This letter, and its enclosure, including PRDE’s approved application, will be posted on the Department’s website.

Please be aware that it is PRDE’s responsibility to continue to comply with Federal civil rights requirements, including Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act, and requirements under the Individuals with Disabilities Education Act.
