OCR conducted an investigation of the University of Notre Dame
regarding its compliance with the regulatory requirements of Title IX of The
Education Amendments of 1972 (Title IX) with respect to the University’s policies
and procedures, and their implementation, relating to sexual violence and other
forms of sexual harassment. OCR conducted site visits in December 2010, January
2011 and April 2011, where it reviewed the University’s policies and procedures
and files related to sexual assault and harassment complaints. OCR also interviewed
individuals familiar with the University’s handling of sexual harassment complaints.
OCR obtained an agreement with the University in June 2011 to improve its policies
and procedures relating to sexual harassment. In the agreement, the University
agreed to 1) revise its policies and procedures to ensure that they provide
for the prompt and equitable resolution of sexual harassment and sexual assault
complaints; 2) provide training to students and staff on the revised policies
and procedures; 3) assess the campus environment to continue to improve the
effectiveness of its handling of sexual harassment complaints; and 4) assure
that students who file complaints are aware of the options available to them
and the resources and services available to them, including counseling services
and academic support. OCR will monitor the University’s actions in implementing
the agreement.
