Title I, Part A: Location of Services
Title I in Religiously-Affiliated Schools:
- The 1997 Supreme Court decision, Agostini v. Felton overturned the earlier Aguilar v. Felton decision and allows Title I services in private, religiously-affiliated schools.
- If services are offered on site at a religious school, they must be provided consistent with the law and in a manner that would not violate the Establishment Clause of the First Amendment. (For example: No religious symbols permitted in the space used for Title I services, no religious instruction on the part of the Title I instructor/s, and no team teaching.) Refer to the Agostini v.
