Establishment of Negotiated Rulemaking Committees

The Secretary of Education (Secretary) announces the establishment of two negotiated rulemaking committees to develop proposed regulations related to the federal student aid programs authorized by Title IV of the Higher Education Act of 1965, as amended (HEA). The first committee will develop proposed regulations for the Teacher Education Assistance for College and Higher Education (TEACH) Grant program. The second committee will develop proposed regulations for other federal student aid programs authorized by Title IV of the HEA.

TEACH Grant Committee Topics, Members, and Meeting Schedule

The Final Rule for the TEACH Grant Program became effective July 1, 2008. This rule was published in the Federal Register on June 23, 2008. On June 30, 2008, a correction notice was published in the the Federal Register.

The Notice of Proposed Rulemaking (NPRM) was published in the Federal Register on March 21, 2008. Public comments were due on or before April 21, 2008.

We completed a total of three negotiated rulemaking sessions, all of which were held at our offices on 1990 K Street, N.W., Washington, DC 20006.

Session 1: January 8 – January 10.
Session 2: January 22 - January 24.
Session 3: February 6 - February 8.

Student Loan Committee Topics, Members, and Meeting Schedule

Title IV Loan Provisions in the College Cost Reduction and Access Act of 2007.
Final Regulations were published in the Federal Register Notice dated October 23, 2008.

The Notice of Proposed Rulemaking (NPRM) that would implement the Title IV loan provisions in the College Cost Reduction and Access Act of 2007 (CCRAA) was published in the Federal Register on July 1, 2008.

The Student Loans Team agreed to add a fourth meeting, scheduled for April 14 - 15, from 9:00 a.m. - 5:00 p.m. on each day. The meeting was held at the 8th Floor Conference Center, 1990 K St. N.W., Washington, D.C.

Announcement:

The Committee agreed to schedule several conference calls prior to the third session for the purpose of further discussing the topics under consideration by the Committee:

  • February 20, 3-5 pm EST to discuss any or all outstanding issues;
  • February 21, 3-5 pm EST to discuss any or all outstanding issues; and
  • February 26, 3-5 pm EST to discuss proposals for the definition on not-for-profit loan holders.

We have scheduled a total of three negotiated rulemaking sessions, all of which will be held at our offices on 1990 K Street, N.W., Washington, DC 20006. The following schedule is subject to change. We will announce any changes to this schedule on this Web site.

Session 1: January 14 – January 16.
Session 2: February 4 - February 6.
Session 3: March 4 – March 6.

For the first negotiating session, the Student Loan Committee met from 9 to 5 p.m. each day. For Session 2, the committee met from 9 to 5 p.m. on February 4th and 5th; and from 9 a.m. to 12 noon on February 6th. For Session 3, the committee met from 9 to 5 p.m. each day.

Notice of establishment of negotiated rulemaking committee

On October 22, the U.S. Department of Education published a notice in the Federal Register announcing our intention to establish one or two negotiated rulemaking committees to prepare proposed regulations for the student assistance programs authorized under Title IV of the Higher Education Act of 1965, as amended (HEA).

The notice also announced three regional hearings where interested parties could suggest issues that should be considered for action by the negotiating committees. These hearings were held on:

  • November 2, 2007, at the Sheraton New Orleans, 500 Canal Street, New Orleans, Louisiana;

  • November 16, 2007, at the U.S. Department of Education, PCP Auditorium, 550 C Street, S.W., Washington, DC; and;

  • November 29, 2007, at the Manchester Grand Hyatt, One Market Place, San Diego, California.;

The regional hearings in New Orleans and San Diego were held from 11:00 a.m.-3:00 p.m., local time. The hearing in Washington, DC was held from 9:00 a.m.-4:00 p.m., local time.

Finally, the notice requested nominations for individual negotiators who represent key stakeholder constituencies that are involved in the student financial assistance programs authorized under Title IV of the HEA to serve on these committees. The deadline date for receiving nominations for negotiators to serve on the negotiating committees was November 29, 2007.
