Legal References and Model Notices

This section of the Privacy Technical Assistance Center (PTAC) Privacy Toolkit provides education stakeholders with a list of important legal resources related to privacy and confidentiality of personally-identifiable information (PII). These resources include relevant materials from the Family Policy Compliance Office (FPCO) and Data Quality Campaign (DQC), including Federal statues, explanations of policy changes affecting protection of PII, and model documents to aid stakeholders in drafting appropriate legal notices when communicating about privacy issues.

Currently, only documents related to Family Educational Rights and Privacy Act (FERPA) are listed. FERPA is a Federal law that protects the privacy of personally identifiable information from student education records.

Model notices

The following documents represent models of forms that can be used to communicate about actions taken in compliance with FERPA regulations or to report their violation. For example, the Model Notice for Directory Information can be used by parents to forbid an educational institution from disclosing their child’s directory records without their prior written consent, and the Model Notification of Rights form can be used by eligible individuals to request access to their educational records.
