Dear Mr. Woolridge:

This is to inform you that I am granting your request for a waiver of the requirement in section 1113(a)(2)(B) of the Elementary and Secondary Education Act of 1965 (ESEA), as amended, concerning Title I school eligibility. This waiver remains in effect for four years, beginning in school year 2011-12.

Approval of this waiver is based on Keene School District’s (Keene) need to ensure continuity of Title I services for eligible children in two elementary schools, Daniels and Symonds Elementary Schools. These two schools, which are on the borderline of the district-wide poverty rate, often fall into and out of eligibility for Title I because small changes in their poverty percentages place them below the district-wide average. This waiver would enable these two schools to continue offering Title I programs to their eligible students without the interruption caused by small demographic changes that affect their eligibility for Title I. All of the schools served by Title I must continue meeting the accountability requirements of the law. In addition, Keene must still meet all of the other requirements of section 1113, such as the 125 percent rule, when allocating funds to individual schools.

Please note that at the end of the second year of the waiver, and each subsequent year, your district must submit a report to your State educational agency that (1) describes the use made of the waiver by the schools; (2) describes how the schools continue to provide assistance to the same population served by the program for which the waiver was granted; and (3) evaluates the progress of the district and the school in improving the quality of instruction or the achievement of students.
