I have attached guidance prepared by this Department on the Supreme Court's recent decision in Agostini v. Felton. This guidance was prepared to assist State educational agencies (SEAs), local educational agencies (LEAs), and representatives of private school children in implementing the Court's decision. It will be available soon on the Department's World Wide Web site (http://www.ed.gov/).
This guidance supersedes any conflicting guidance based on the Court's prior decision in Aguilar v. Felton in the April 1996 Policy Guidance for Title I, Part A--Improving Basic Programs Operated by Local Educational Agencies. The Policy Guidance will be updated at a later date to reflect the Court's decision in Agostini.
I am hopeful that Agostini will open a new era of cooperation and communication between public and private school officials by providing flexibility and easing the tensions created by the Aguilar v. Felton decision. This is truly a time for us to work toward our common goal: the education of our Nation's children.
