Departmental Law and Postsecondary Education

Departmental Law and Postsecondary and Education is under the direction of a Deputy General Counsel who reports directly to the General Counsel. The Deputy General Counsel supervises and coordinates the work of two Divisions, each of which is headed by an Assistant General Counsel and Deputy Assistant General Counsel:

The Business and Administrative Law Division provides legal services to Department officials concerning business management and administrative activities throughout the Department, including contracts, grants, procurement, employment, labor relations, appropriations, budget, advisory committees, copyrights, trademarks, delegations of authority, information law, and Departmental management. The Division helps the Department carry out the requirements of the Freedom of Information Act, the Privacy Act, The Federal Advisory Committee Act, the Government in the Sunshine Act, the Family Educational Rights and Privacy Act, the Equal Employment Opportunities Act, the Department of Education Organization Act, the Federal Vacancies Reform Act, the Federal Tort Claims Act, and the Federal Acquisition Regulations. The Division also provides advice and representation regarding organizational matters involving the Department and claims by and against the Department.

The Postsecondary Education Division provides legal services for postsecondary education programs administered by the Assistant Secretary for Postsecondary Education. These programs include student financial aid programs, such as the Direct Student Loans, Pell Grants, and Federal Family Education Loans, as well as fellowship programs and programs to institutions of higher education for a variety of specified purposes.
