Title IX: Sexual Harassment: Eastern Michigan University (MI): (15096002)

Eastern Michigan University (University) submitted an agreement to resolve a Title IX compliance review that OCR initiated. Prior to the conclusion of OCR’s investigation and any findings, the University asked to enter into a Voluntary Resolution Agreement which, when fully implemented, will ensure that the University does not discriminate on the basis of sex in the educational programs and activities that it operates. The agreement requires the University to: revise its Title IX grievance procedures that address complaints of sex discrimination, including sexual harassment and sexual assault, and its nondiscrimination notice and to effectively publish these materials; designate one or more Title IX coordinators and ensure that they, and other appropriate administrators, receive appropriate training on Title IX and how to investigate complaints of sexual harassment; develop, with OCR’s assistance, an online Title IX training program that will be completed by its employees, including coaches and residential assistants; create a committee, including representation from student groups, the Title IX Coordinator, and others to identify strategies for ensuring that students understand their rights under Title IX and strategies for the prevention of sexual harassment/sexual assault incidents, including outreach and educational activities; revise its existing freshman orientation program and returning student orientation program to include topics that will cover: how to recognize sexual harassment, the connection between alcohol abuse and sexual harassment and sexual assault, students’ ability to speak with a University counselor if they are concerned about issues of sexual harassment, the University’s updated grievance procedures for Title IX complaints, and other information and resources regarding Title IX; develop procedures for an “on call” contact for victims of sexual assault; develop and distribute informational publications for students on sexual harassment and sexual assault; host events to raise awareness of Title IX on campus; conduct climate checks with students on campus to assess the effectiveness of steps the University has taken pursuant to the agreement; review its campus police records from 2009-2010 to identify any sexual assault that was treated solely as a criminal matter to determine if sexual harassment occurred in violation of Title IX and whether the remedies provided were effective; and share information with OCR regarding its response to sexual harassment complaints for the next few school years.
